We are NOT officially affiliated with, endorsed by, or representing any AI model providers (including but not limited to VEO3, Claude, Gemini, or others). Our service is an independent platform that integrates various AI technologies to deliver face swap and meme generation capabilities.

2. Service Description

Kirkified AI is an AI-powered face swap and meme generation service. We provide:

• Free and premium subscription tiers

3. User Eligibility

4.2 Responsible Use & User Obligations

By using our service, you agree to:

• Use our service ONLY for parody, satire, and humorous purposes
• Label all AI-generated content appropriately when sharing on social platforms
• Obtain proper consent before using images of identifiable individuals
• NOT use the service to impersonate, deceive, or mislead others
• Respect the rights and dignity of all individuals
• NOT attempt to reverse engineer or exploit the service
• Comply with all applicable platform policies (TikTok, X, Instagram, etc.)
• Take responsibility for how you use and share generated content

4.3 Enforcement

We take violations seriously. If you violate these policies:

• Your content will be immediately removed
• Your account will be suspended or permanently terminated
• We will cooperate with law enforcement if illegal activity is detected
• No refunds will be provided for policy violations

Payment Provider Notice: Misuse of our service (including creating non-satirical deepfakes, impersonation, or deceptive content) may result in permanent account termination and reporting to payment processors. This protects our platform and all legitimate users.

5. Intellectual Property

5.1 Your Content

• You retain ownership of images you upload to our service
• You grant us a license to process your images for providing the service
• Generated memes created using our service are owned by you
• You are responsible for ensuring you have rights to use uploaded images

5.2 Our Platform

• Kirkified AI, our logo, and branding are our intellectual property
• Our software, algorithms, and platform design are protected by copyright
• You may not copy, modify, or distribute our platform code or design

6. Subscriptions and Payments

6.1 Free Tier

• Limited daily generations (10 free generations per day)
• Access to basic features
• No payment required

6.2 Premium Subscriptions

• Charged on a recurring basis (monthly or annually)
• Pricing clearly displayed on our pricing page
• Automatic renewal unless canceled
• Credits are non-transferable and expire upon subscription cancellation

6.3 Payment Processing

Payments are processed securely through third-party payment providers (Stripe, Creem, PayPal). By subscribing, you agree to their respective terms of service.

6.4 Refund Policy

• Refunds are provided on a case-by-case basis

• Used credits are non-refundable

7. Cancellation and Account Termination

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIRKIFIED AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
